Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PunchMe mobile application and website ("Service"), operated by Hostspica("we", "our", or "us"). By downloading the App or accessing the Service, you agree to be bound by these Terms.

1. Use of Service

You may use PunchMe only if:

• You are at least 18 years of age
• You are an authorized employee of a company that has subscribed to PunchMe
• You comply with all applicable laws and regulations
• You have not been previously suspended or removed from the Service

2. Accounts and Authentication

• Access is granted via OTP authentication to your registered mobile number. You are responsible for keeping your device secure.
• Your account is personal and non-transferable. Do not share your login access.
• Each employee account may be bound to one device at a time. Using the account on multiple devices may trigger fraud detection.
• Notify your employer or PunchMe support immediately if you suspect unauthorized access to your account.

3. Employer Relationship

PunchMe is a B2B service. Your employer (the "Company") subscribes to PunchMe and configures attendance policies including:

• Office locations and geofence boundaries
• Required verification methods (GPS, face recognition, selfie)
• Shift schedules and working days
• Leave types and quotas

Hostspica acts as a data processor on behalf of your employer. Your employer's policies and instructions govern how attendance data is used within their organization. Hostspica is not responsible for employment decisions made based on attendance data.

4. Biometric Data Consent

If your employer has enabled face recognition:

• You consent to the capture of your facial image and generation of a biometric face embedding for the purpose of attendance verification.
• Face embeddings are stored in Firebase Firestore and used only for identity verification at check-in.
• You may withdraw consent by contacting your employer to disable face recognition or by requesting deletion of your face enrollment from your Profile screen.
• Face data will be deleted within 30 days of account termination or enrollment deletion.

5. Prohibited Conduct

You agree not to:

• Use mock GPS, VPN, or any tool to spoof your physical location
• Use photos, masks, or digital replicas to bypass face recognition
• Allow another person to use your account or perform check-in on your behalf (buddy punching)
• Reverse engineer, decompile, or tamper with the App
• Attempt to access data or systems beyond your authorized scope
• Use the Service in any way that violates applicable law or your employer's policies

Violation of these prohibitions will result in account suspension and may result in legal action.

6. Subscription and Payments

• Subscriptions are billed per active employee, monthly or annually, as chosen by the employer.
• All payments are processed by Razorpay. Hostspica does not store credit card or bank details.
• Subscriptions auto-renew unless cancelled before the next billing date.
• Refunds are handled on a case-by-case basis. Contact us within 7 days of billing if you believe an error occurred.
• Prices are subject to change with 30 days' notice. Continued use after the notice period constitutes acceptance.

7. Intellectual Property

All software, designs, trademarks, and content in PunchMe are owned by Hostspica. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose. No other rights are granted.

8. Limitation of Liability

To the maximum extent permitted by law:

• Hostspica is not liable for employment decisions, disciplinary actions, or disputes arising from attendance records.
• We are not liable for service interruptions caused by third-party infrastructure (Firebase, Cloudflare, Google Play).
• Our total liability for any claim arising from use of PunchMe shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

10. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without notice, for any violation of these Terms. Upon termination, your right to use the Service ceases immediately and your data will be deleted per our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via the App or email with 14 days' notice. Continued use of the Service after that date constitutes acceptance.
